SM Entertainment has finally has let its sword loose from the case and is ready to swing….

Three members of DBSK (Hero, Xiah, Micky) failed to reach an agreement with SM in regards of their lawsuit on validity of their contracts with SM Entertainment.

During a phone interview, the judges responsible for DBSK vs SM case provided updates on the lawsuit. They commented that “Both sides have submitted their evidences on September 11th. Both sides are still expressing their arguments, and therefore we believe that the mutual agreement did not occur. After we finish reviewing the submitted evidences and gather up our decision, we will notify both sides with our results. We believe that the results will be notified in September.”

Previously, the court has announced that they will only have one hearing and make a decision based on the submitted evidences so they have kept their words so far.

DBSK fans have sued SM Entertainment under Korea’s department of business bureau, claiming that the contract between DBSK and SM is unfair and unlawful. They also made a claim regarding the cancellation of “SM Town Live 09″, saying that DBSK wanted to execute concert but SM had stopped them doing so. For the concert cancellation claim, DBSK fans are demanding an official statement from SM – that they are sorry - and 10% of concert ticket fees in extra.

During the public annoucement of new Kdrama “Heading on bare floor”, DBSK’s U-Know Yoon-Ho have stated that he would likethe DBSK’s lawsuit issue to be resolved logically and without any conflicts. After filming of the drama began, he only met other DBSK members during night and they are all encouraging him with his new role and new career. During day time, he communicates to other members using text messaging.

When he was asked “Would DBSK be disbanded?” he replied “Don’t be so pessimistic”. He stated that there are too many bad rumors regarding the issue and that the rumors might have negative effects on the issue. He had hoped that people didn’t believe in those rumors.

The drama will be first aired on September 9th.

Well, U-Know has some good points there but as one of the main source of “DBSK rumors”, here is what I have to say: I am not creating any rumors on my own, I am simply broadcasting rumors from a reliable source. I know that some might not be true and I am sure that our readers are very well aware of that. I am simply making sure that fans of DBSK get to know what they ought to know. When DBSK’s lawsuit first surfaced, it was publicly reassured that 2009 SM Town concert would not cancel but rumors were pessimistic. A week later, the concert was suddenly cancelled and tickets were all refunded. But what about non-refundable reservations or change in vacation planning?
